Liability Release and Assumption of Risk - SM Tennis

I, the participant, acknowledge that I have voluntarily applied to book/participate in activities offered by SM Tennis (“SM Tennis”).

I AM AWARE THAT THESE ACTIVITIES INVOLVE INHERENT RISKS AND THAT I MAY BE SERIOUSLY INJURED OR KILLED. I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH FULL KNOWLEDGE OF THE DANGERS INVOLVED AND AGREE TO ASSUME ANY AND ALL RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER SUCH RISKS ARE KNOWN OR UNKNOWN.

As consideration for being permitted by SM Tennis, the State of California (“State”), the county in which the activity occurs (“County”), and any lessor of the premises (“Lessor”) to participate in these activities and to use the related facilities, I hereby forever release and discharge SM Tennis, the State, the County, the Lessor, all affiliated organizations, and their respective directors, officers, coaches, employees, and agents (“Releasees”) from any and all actions, claims, demands, or liabilities that I, my assignees, heirs, distributees, guardians, next of kin, spouse, or legal representatives now have or may have in the future arising from:

(i) my participation in these activities and my engagement of any kind with this website
(ii) the negligence or other acts of any Releasee, whether directly related to the activities or not and however caused, or
(iii) the condition of the premises where the activities occur, whether or not I am participating at the time.

I further agree that I, my assignees, heirs, distributees, guardians, next of kin, spouse, and legal representatives will not make a claim against, sue, or attach the property of any Releasee in connection with any matter covered by this release.

By booking/participating in any SM Tennis–related sessions or utilizing any SM Tennis services, I grant SM Tennis the unrestricted right to capture and use photographs, video, or other media of me for promotional, marketing, and business purposes, without compensation or further approval.

By visiting this website/booking/participating in any SM-Tennis related session or utilizing any SM-Tennis service provision, I hereby release the service provider Shawn Merchant and SM Tennis as a whole from any and all liability and agree to fully assume all risk, both known and unknown indefinitely.

I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I UNDERSTAND THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND SM TENNIS, THE STATE, THE COUNTY, AND THE LESSOR, AND I AGREE TO IT OF MY OWN FREE WILL.

By visiting this website, I verify that the dangers of the activities and the significance of this Release and Waiver have been explained to me, the Participant, and that I, the Participant, understand them fully.

I verify and agree to this release agreement in its entirety without exception.
